The terms “you” and “your” refer to anyone who visits, views, or uses the Website. “Sparks & Swoons Coaching,” “Company,” “I,” “we,” and “us” refer to Dana Cole, doing business as Sparks & Swoons Coaching.

Changes to These Terms
We may update these Terms and Conditions at any time. Changes become effective when posted on the Website. Your continued use of the Website after changes are posted means that you accept the revised terms.
It’s your responsibility to review this page periodically for updates.
Age Requirement
The Website and its content are intended for adults who are at least 18 years old. Individuals under 18 may not use the Website, submit personal information, or purchase coaching services or products.
Privacy Policy
Your use of the Website is also subject to our Privacy Policy. Please review it to understand how information submitted through the Website may be collected, used, and protected.
Disclaimer
Your use of the Website is also subject to our Disclaimer, which is incorporated into these Terms and Conditions.
Coaching Services—Not Therapy
Sparks & Swoons Coaching provides personal and creative coaching for writers. Coaching services may include Brainspotting-informed techniques, Parts Work, reflection, goal exploration, and support related to creativity and writing blocks.
Coaching is not psychotherapy, counseling, medical care, crisis intervention, or mental health treatment. It doesn’t diagnose or treat trauma, mental health conditions, or active mental health symptoms and isn’t a substitute for services from a licensed healthcare professional.
Visiting the Website, reading its content, submitting an inquiry, or purchasing a product doesn’t create a therapist-client relationship.
A coaching relationship begins only after both parties have completed the required intake process and entered into a separate coaching agreement. That agreement will govern the coaching relationship, including scheduling, payment, cancellations, confidentiality, scope, and termination.
No Professional Advice
The content on this Website is provided for general informational and educational purposes. Nothing on the Website should be understood as medical, psychological, legal, financial, publishing, or other professional advice.
You’re responsible for deciding whether information, products, or coaching services are appropriate for your circumstances. Consult a qualified professional when you need advice specific to your health, legal rights, finances, publishing business, or personal situation.
No Guarantees
We make no guarantees regarding the results you may experience from using the Website, purchasing a product, or participating in coaching.
Examples, testimonials, and descriptions of possible outcomes don’t promise that you’ll experience the same results. Your progress depends on many factors, including your individual circumstances, participation, decisions, and actions.
Coaching doesn’t guarantee that you’ll overcome a writing block, complete or publish a manuscript, earn income, secure representation, receive a publishing contract, or achieve any particular creative or business result.
Intellectual Property
Unless otherwise stated, the Website and its original content—including text, graphics, logos, designs, photographs, videos, audio, downloads, worksheets, courses, and other materials—belong to Sparks & Swoons Coaching or are being used with permission.
This content is protected by applicable copyright, trademark, and other intellectual-property laws.
You’re granted a limited, revocable, nonexclusive, nontransferable license to view, print, or download Website content for your own personal, noncommercial use.
Without prior written permission, you may not:

- Use the content to train artificial-intelligence systems or create competing products
Purchasing a product gives you permission to use it personally. It doesn’t transfer ownership of the product or its intellectual-property rights to you.
Your Creative Work
You retain ownership of the manuscripts, characters, ideas, notes, and other original creative work you share during coaching or through private intake and contact forms.
Sharing creative material for the purpose of receiving coaching doesn’t give Sparks & Swoons Coaching permission to publish, sell, distribute, or claim ownership of that work.
Testimonials, success stories, excerpts, identifying information, or other client material will only be used publicly with separate permission.
Public Submissions
If you voluntarily post content in a public area of the Website or on a Sparks & Swoons Coaching social-media page, you confirm that you own the content or have permission to share it.
You grant us only the limited permission reasonably necessary to display, moderate, or respond to that content on the platform where it was submitted. This doesn’t give us ownership of your content.
You may not submit content that:
- Violates a law or another person’s rights

- Is defamatory, abusive, threatening, hateful, obscene, or intentionally disruptive
- Contains malware, viruses, or harmful code

We may remove public submissions that violate these Terms or interfere with the operation of the Website.
Lawful Use
You agree to use the Website only for lawful purposes.
You may not interfere with the Website’s operation, attempt to access restricted areas, collect information about other users without permission, impersonate another person, or use the Website in a way that could harm the Company or another party.
Products and Digital Materials
We may offer free or paid products, courses, downloads, programs, workshops, or other materials.
Unless a product’s individual purchase terms state otherwise, products are licensed to one purchaser for personal, noncommercial use. They may not be copied, shared, resold, reproduced, modified, distributed, uploaded, or used to create derivative or competing products.
Prices, features, availability, and product descriptions may change at any time.
Payment, refund, cancellation, and access terms displayed at checkout or within a separate purchase or coaching agreement are incorporated into these Terms.
Third-Party Links
The Website may include links to third-party websites, services, booking platforms, payment processors, or other resources.
We don’t own or control those third parties and aren’t responsible for their content, availability, privacy practices, security, products, or services. Your use of a third-party website is governed by that party’s terms and policies.
You assume responsibility for reviewing those terms before providing information or completing a transaction.
Affiliate Links
Some links may be affiliate links. This means we may receive compensation if you make a purchase through the link, at no additional cost to you.
The presence of an affiliate link doesn’t guarantee that a product or service will be appropriate for your needs. You’re responsible for evaluating any purchase before completing it.
Website Availability
We may update, restrict, suspend, or discontinue any part of the Website or its offerings at any time.
We don’t guarantee that the Website will always be available, uninterrupted, secure, or free from technical errors, viruses, or other harmful components.
Disclaimer of Warranties
To the fullest extent permitted by law, the Website, its content, and its products are provided “as is” and “as available,” without warranties of any kind, either express or implied.
We don’t warrant that the Website or its content will be complete, accurate, reliable, current, uninterrupted, secure, or suitable for a particular purpose.

To the fullest extent permitted by law, Sparks & Swoons Coaching and its owners, employees, contractors, and affiliates won’t be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of—or inability to use—the Website, its content, products, or services.
Nothing in these Terms excludes or limits liability that can’t legally be excluded or limited.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Sparks & Swoons Coaching and its owners, employees, contractors, and affiliates from claims, liabilities, losses, damages, or reasonable legal expenses resulting from:
- Your unlawful use of the Website
- Your violation of these Terms
- Content you submit publicly
- Your infringement of another party’s rights
Refusal or Termination of Access
We may restrict or terminate access to the Website, its content, or its products when we reasonably believe a user has violated these Terms, misused the Website, infringed intellectual-property rights, or created a security or legal risk.
Governing Law and Disputes
These Terms and Conditions are governed by the laws of the State of Virginia, without regard to conflict-of-law principles.
Before filing a legal claim, both parties agree to make a good-faith attempt to resolve the dispute informally by providing written notice and allowing 30 days for a response.
If the dispute can’t be resolved informally, any legal action will be brought in the appropriate state or federal courts located in Hanover, Virginia, unless applicable law requires otherwise.
Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.
No Waiver
A failure to enforce any part of these Terms doesn’t waive the right to enforce it later.
Entire Agreement
These Terms, together with the Website’s Privacy Policy and Disclaimer, form the entire agreement concerning your use of the Website.
They don’t replace any separate coaching agreement, purchase agreement, refund policy, or other contract entered into between you and Sparks & Swoons Coaching.
